Owners of Units (in all Phases) wishing to lease their units
must abide by the following regulations:
a)These Rules apply to any rental agreement, license or
other use or occupancy of any Unit that is entered into with an Owner for money
or any other valuable
consideration. These Rules do not apply
to any use or occupancy of a Unit when the Owner is present, or by the family
or guests of the Owner – so long as there is no money or other valuable
b)A Rental Notice and Agreement must be completed and
filed with the Management Company no later than 10 days prior to the
commencement of each rental. A $2,000.00 security deposit must
accompany the notice and agreement. The security deposit must be on file for
damages, cost of management, and similar items with the Management Company no
later than 10 days prior to entering into any lease agreement. Forms for the Rental Notice and Agreement are
available from the Management Company and are posted in the Pool House above
the drop box.
c)The Board, may, from time to time, investigate
provide to renters copies of these Rules, and of the applicable individual
associations Rules, copies of which will be attached to the Rental Notice and
Agreement. Renters must sign an
acknowledgement contained in the Rental Notice and Agreement agreeing to abide
by these Rules.
e)The minimum rental period is four consecutive weeks. Sham documentation for the purpose of
circumventing this Rule will be considered a violation of this Rule.
f)A maximum of six persons (adults and children) is
permitted for overnight occupancy of any one rented Unit.
g)No animals shall be kept in any Unit or the Common
Elements, except for dogs and cats (but not more than two (2) animals per
Unit). Notwithstanding the above, pitbulls and Rottweilers are not allowable
h)The Board has the power and authority to assess fines and
collect the following expenses against the Owner as follows:
a.$200.00 per day for each day of violation of these
Rental Restrictions, commencing the day immediately after notice of such
violation has been given to the Owner.
b.$500.00 for failure to complete and submit the Rental
Notice and Agreement to the Master Association.
c.$500.00 for failure to deposit the rental security
deposit with the Master Association.
d.Any fees and costs associated with enforcing these
Rental Restrictions, including any legal fees and costs paid to an attorney
and/or to a court of law.
i)Before a security deposit is returned to the Owner, the
deposit will be applied first to any unpaid assessments
as well as costs due the Association (including attorneys' fees, litigation and
fees relating to the placement and removal of any liens against the Unit). Any remaining funds, if available, will be
returned to the Owner.
Enforcement of this rule X shall
be in accordance with rule XI below. Any
such fines levied by the Board shall constitute a lien against such Unit and
may be collected and enforced as a lien in accordance with the applicable
provisions of Section 7 of the Declaration and the Code.
